STOA rfelief to industries in Haryana

Further to denial of Short term Open Access  STOA by power utilities to industrial consumers in Haryana, an immediate interim relief have been granted by Honorable Punjab and Haryana high court.

In and order dated 14.05.2014 Government had restrained the Electricity Department not to give 'no objection certificate' for short term open access to any person and restricted the short term open access in the State to import power till further orders

.As per Clause 16, sub-clause 5 of the notification dated  11.01.2012, in case the nodal agency has not communicated any deficiency or defect in the application within two working days from the date of receipt of application, or refusal or consent within the specified period of five working days,the consent shall be deemed to have been granted. 

Commission being the expert body created to regulate the electricity disputes, has further observed that there has no permanent damage to the HVPNL or the distribution companies, if open access was allowed or denied because, if there is over loading of the line at the relevant time, power shall not flow on that line. If at that time, capacity is available in some other corridor, then full power shall flow to the advantage of the open access consumers. While granting stay of the notification dated 14.05.2014, it has been observed by the Commission that balance convenience in terms of gain was in favor of the consumers. 

keeping in mind all facts the honorable court has directed STU to issue NOC for STOA till pendency of this petition.
